Terms & Conditions

CENTENARY EASTER EGG PRIZE DRAW

1.   THE PROMOTER

The promoter is: Bettys and Taylors of Harrogate Ltd of 1 Parliament St., Harrogate, HG1 2QU, a company registered in England and Wales with company registration number 00543821 (Promoter).

2.   THE PRIZE DRAW

2.1   The title of the competition is ’Centenary Easter Egg Competition’.

2.2   To enter, fill in your details on the competition web page. A winner will be drawn at random.

3.   HOW TO ENTER

3.1   The prize draw will run from 09:00 on 11th March 2019 (Start Date) to 23:59 on 12th April 2019 (Closing Date) inclusive.

3.2   All prize draw entries must be received by the Promoter through the web entry form during the period referred to in Condition 301 above by no later than 23:59 on the Closing Date. All prize draw entries received after the Closing Date are automatically disqualified.

3.3   To enter the prize draw submit the online entry form any time from the Start Date on www.bettys.co.uk by no later than 23:59 on 12th April 2019.

3.4   No purchase necessary and there is no charge to enter online.

3.5   By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions.

3.7   The prize draw winners will be drawn at random.

4.   ELIGIBILITY

4.1   The prize draw is only open to all residents in the UK aged 18 years or over, except:

(i)   employees of the Promoter or its holding or subsidiary companies;

(ii)   employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or

(iii)   members of the immediate families or households of (a) and (b) above.

4.2   In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the prize draw.

4.3   The Promoter will not accept prize draw entries that are:

(a)   automatically generated by computer;

(b)   completed by third parties or in bulk; or

(c)   incomplete.

4.4   There is a limit of one entry to the prize draw per household.

4.5   The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

5.   THE PRIZE

5.1   The prize is a Bettys Centenary Easter Egg. There are three to be won.

5.2   Prizes are subject to availability. There is no cash alternative for the prize.

5.3   The prize is not negotiable.

5.4   In order to claim the prize you must reply to our email notifying you of the win within seven days.

6.   WINNER ANNOUNCEMENT

6.1   The decision of the Promoter is final and no correspondence or discussion will be entered into.

6.2   The Promoter will contact the winners personally as soon as practicable after the prize draw closes, using the email address provided with the prize draw entry (Announcement Date).

6.3   The Promoter will send the name and county of the winners to anyone who writes within one month after the Closing Date of the prize draw requesting details of the winner and who encloses a self-addressed envelope to the address set out in Condition 1 above.

7.   CLAIMING THE PRIZE

7.1   If you are the winner of the prize, you will have seven days from the Announcement Date to claim the prize by providing the Promoter with a postal address to which we can send the prize. If you do not claim the prize by this date, your claim will become invalid.

7.2   The prize may not be claimed by a third party on your behalf.

7.3   The Promoter will make all reasonable efforts to contact the winner. If a winner cannot be contacted, or is not available, or has not claimed their prize, within seven of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4   The Promoter does not accept any responsibility if you are not able to take up the prize.

8.   LIMITATION OF LIABILITY

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9.   DATA PROTECTION AND PUBLICITY

9.1   The Promoter will only process your personal information as set out in the privacy policy.

10.   GENERAL

10.1   If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.

10.2   The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

10.3   These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

Bookable Afternoon Tea Terms and Conditions:

The following special conditions will apply to Bookable Afternoon Tea bookings:
A pre-authorisation payment of £0.02 will be made and refunded on your card for the purposes of validating your card details. A £10 charge will be incurred if you fail to arrive for your reservation without notice, or cancel your reservation within 48 hours of your reservation time. A charge of £10 per person will be made. We will hold your table for up to 15 minutes after the time of your reservation. We reserve the right to release your table if you have not arrived by this time or called to let us know you are running late.

Egg Free Delivery Terms and Conditions:

Enter the code 'EGG' within your basket and click ‘APPLY’.Please note free delivery will be valid only on orders of £40 or more, excluding postage and applies to one delivery address only. Free delivery is applicable to our Named Day service which is available Monday to Friday. Once the code has been accepted your discount will be applied at the checkout page. The code cannot be used in conjunction with any other offer. Gift voucher purchases are not included in this Free Delivery offer. Offer applies to UK mainland delivery addresses only. Please note, some remote parts of the UK and Highlands & Islands are excluded from the UK mainland classification by our couriers. Bettys Centenary Memory Hub 2018: Terms and Conditions

1.   The Bettys Centenary Memory Hub is owned and run by Bettys and Taylors of Harrogate Ltd (“Bettys”) of 1 Parliament St., Harrogate, HG1 2QU.

2.   By submitting a comment with your story and any accompanying material below the Facebook post dated Saturday 6 October 2018 at 09:00, you are agreeing to be bound by these terms and conditions.

3.   Bettys will cease to review all comments submitted under the Facebook post dated Saturday 6 October 2018 at 09:00 at midnight on Wednesday 31 October 2018. Bettys cannot guarantee that any comments added under the Facebook post after this date will be read and considered.

4.   Bettys will not accept stories and any accompanying materials, and reserves the right to delete any that are:

  1. illegible, have been altered, reconstructed, forged or tampered with;

  2. offensive; and

  3. infringe the intellectual property rights of any third party.

5.   If your story and any additional material is selected to be featured on the Centenary Memory Hub, Bettys will not contact you beforehand.

6.   If your story and any additional material is to be considered by Bettys for featuring in a Centenary Film, you consent to Bettys making contact with you via Facebook.

7.   All information and data contained in the comments section below the Facebook post dated Saturday 6 October 2018 and any accompanying material posted, whether used in the Centenary Memory Hub or not or in a Centenary Film or not, will become the property of Bettys upon posting and will not be returned.

8.   If your story and (if applicable) accompanying materials, are selected to feature on the Memory Hub, Bettys reserve the right to:

  1. Amend any comment that contains a typographical error.

  2. Shorten any story in order to fit to space requirements on the memory Hub.

9.   By submitting your story and any accompanying material, you agree to:

  1. assign to Bettys all your intellectual property rights with full title guarantee; and

  2. waive all moral rights,

in and to your story and otherwise arising in connection with your submission to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

10.   You agree that Bettys may, but is not required to, make your entry available on its website www.bettys.co.uk and any other media, whether now known or invented in the future, and in connection with any publicity of the memory hub and/or Centenary Film. You agree to grant Bettys a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the story and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the story and any accompanying materials for such purposes.

11.   Should your story be chosen to feature on the Memory Hub, Bettys will only publish your name as it appears on the Facebook account to which you posted the story and accompanying materials. In any event, access to our privacy policy can be found at https://www.bettys.co.uk/privacy-policy/

12.   If there is any reason to believe that there has been a breach of these terms and conditions, Bettys may, at its sole discretion, reserve the right to delete from its Facebook page and exclude your story and any accompanying materials.

13.   If your story is chosen for filming and the potential to feature in a Bettys Centenary Film, you accept and understand that:

  1. Bettys have the complete discretion and the final decision as to;

    1. the content filmed;

    2. the editorial aspects of the film;

    3. the location of the filming;

    4. whether the filming of your story is included in a final Centenary Film;

  2. Should you be selected for filming, there is no guarantee that it will be included in the final version of a Centenary Film.

  3. Bettys retain all intellectual property rights in all filming captured, whether the filming is included in the final film, or not.

14.   You agree that Bettys may, but is not required to, make your entry available on its website www.bettys.co.uk and any other media, whether now known or invented in the future, and in connection with any publicity of the memory hub and/or Centenary Film. You agree to grant Bettys a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the story and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the story and any accompanying materials for such purposes.
